BBP Software — Disclaimer & End-User License Terms

Terms version 1.0 — effective October 10, 2026

These terms apply to AutoDiag and HDD Tune (the "Software"), published by BBP Heavy Duty Diesel Diagnostic and Tuning, LLC, a Texas limited liability company ("BBP", "we", "us"). By installing, opening, or using the Software you ("you", the "User") agree to these terms. If you do not agree, do not use the Software.

1. License

BBP grants you a personal, non-exclusive, non-transferable, revocable license to use the Software on computers you own or control, for lawful diagnostic, service, and calibration work on vehicles you own or are authorized by the owner to work on. You may not resell, sublicense, or redistribute the Software, or remove its notices, without BBP's written permission. BBP keeps all rights not expressly granted.

2. Provided "as is" — no warranty

To the fullest extent permitted by law, the Software is provided "AS IS" and "AS AVAILABLE," with all faults. BBP disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy. BBP does not warrant that the Software is error-free, will work with any particular vehicle, adapter, module, or computer, or that any reading, code definition, coding option, or calibration value is correct. Some jurisdictions do not allow certain warranty exclusions; in that case those exclusions apply only to the extent permitted.

3. Assumption of risk

Working on vehicle electronics carries real risk. You understand and accept that:

  • Coding, adaptations, resets, configuration changes, and flashing or writing calibrations can damage or disable control modules ("brick" them), cause warning lights or fault codes, cause drivability or mechanical problems, and require dealer repair or module replacement.
  • Such changes can void manufacturer or extended warranties, affect insurance coverage, and make a vehicle unsafe to drive or not legal for road use, registration, or inspection in your state.
  • Interrupted communication, low battery voltage, adapter faults, or software errors can leave a module in an unusable state.
  • You choose to make any change, and you do so at your own risk.

4. Your responsibilities

  • Back up first. Before any write, coding, or flash, save the original module coding, configuration, and calibration files, and keep them safe.
  • Verify. Independently confirm every reading, code meaning, option, and value against factory service information before acting on it. The Software is an aid, not a substitute for professional judgment.
  • Unverified data. Some data in the Software (for example certain manufacturer-specific readings, coding options, and calibration definitions) is labeled UNVERIFIED. Treat UNVERIFIED items as untested; use them only if you can confirm them yourself.
  • Use only quality adapters and cables, and keep the Software and your computer in good working order.

5. Safe-use rules

  • Use the Software only with the vehicle parked, transmission in Park (or Neutral with the parking brake set), on level ground, in a ventilated area.
  • Never operate the Software while driving, and never let it distract a driver. Live data or road testing requires a separate passenger operator and must obey all traffic laws.
  • Connect a battery support / maintainer (stable voltage supply) for coding, adaptations, and any write or flash; do not let voltage drop or the laptop sleep during a write.
  • Do not disconnect the adapter or switch the ignition during a write unless the Software instructs you to.
  • Keep clear of moving parts, hot surfaces, and fans when the engine is running.

6. Prohibited uses

You agree not to use the Software, or any file or data produced with it, to:

  • Remove, disable, defeat, bypass, or render inoperative any emissions-control device or element of design, or tamper with emissions-related calibrations or monitors, in violation of the U.S. Clean Air Act (42 U.S.C. § 7522) or any state law. Off-road or competition-only claims do not make tampering with a road vehicle legal.
  • Alter, roll back, or misrepresent odometer mileage (49 U.S.C. § 32703 and state law).
  • Defeat, bypass, or clone an immobilizer, key, or other anti-theft system, except on your own vehicle as permitted by law.
  • Disable or impair safety systems, including airbags/SRS, ABS, ESP/stability control, brakes, seat-belt systems, lighting required by law, or driver-assistance systems.
  • Work on any vehicle without the owner's authorization, or commit fraud, theft, or any unlawful act.

BBP may terminate your license immediately if you violate this section.

7. Compliance with laws

You alone are responsible for making sure your use of the Software, and any vehicle you modify, complies with all applicable federal, state, and local laws, including emissions, safety-equipment, inspection, registration, and consumer-protection laws, and the terms of any vehicle warranty or lease.

8. Limitation of liability

To the fullest extent permitted by law:

  • BBP will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of use, lost profits, loss of data, towing, rental, downtime, or vehicle or module repair or replacement costs, arising from or related to the Software or these terms, even if BBP was advised of the possibility.
  • BBP's total liability for all claims relating to the Software or these terms is limited to the amount you actually paid BBP for the Software in the twelve (12) months before the claim (or US $0 if the Software was provided free of charge as a beta or preview).
  • Exceptions. Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, or fraud, or for personal injury or death where such limits are prohibited, and nothing waives any non-waivable rights you have as a consumer, including under the Texas Deceptive Trade Practices–Consumer Protection Act, to the extent those rights apply to you.

9. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless BBP and its owner, members, employees, and agents from claims, damages, fines, penalties, and expenses (including reasonable attorneys' fees) brought by third parties or government authorities arising from your misuse of the Software, your violation of these terms, or your violation of any law, including any prohibited use in Section 6. This does not apply to the extent a claim is caused by BBP's own gross negligence or willful misconduct.

10. Updates and changes

BBP may update the Software and these terms. When the terms change, the Software will ask you to accept the new version before continued use. The version you most recently accepted governs your use.

11. Governing law and venue

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and applicable U.S. federal law. Subject to any non-waivable consumer rights, disputes will be brought in the state or federal courts located in Texas.

12. Severability and entire agreement

If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest of these terms remain in full effect. These terms are the entire agreement between you and BBP about the Software and supersede prior statements about it. BBP's failure to enforce a provision is not a waiver.
